Electronic Signature & Communications Disclosure

How UtilityProviders delivers electronic notices, receives electronic submissions, and handles consent when you use our online comparison, referral, alert, solar, or business-energy tools.

Please read this disclosure before giving electronic consent.

Utility Providers LLC ("UtilityProviders," "we," "us," or "our") operates UtilityProviders.com as an independent energy comparison and referral website. We use online forms, email, website notices, and—where you separately opt in—text messages to communicate about requests you initiate through our website.

1. Purpose of this Disclosure

Certain laws may require particular notices, agreements, disclosures, or other records to be provided "in writing." Federal law recognizes electronic records and electronic signatures in transactions affecting interstate commerce and, for certain consumer disclosures, establishes requirements for affirmative electronic consent. This disclosure explains the conditions under which UtilityProviders may provide or receive communications electronically. The E-SIGN Act generally prevents a record or signature from being denied legal effect solely because it is electronic, while preserving specific consumer-consent requirements when information is legally required to be provided in writing.

This disclosure is intended to apply only to electronic interactions that UtilityProviders actually offers. It does not create a utility account, establish service with an energy provider, or replace any separate terms or disclosures that a utility, retail supplier, solar company, referral partner, or other third party may require.

2. Definitions

"You" and "your" mean the person using UtilityProviders.com and, when applicable, an authorized representative submitting a request on behalf of a household or business.

"Communications" means electronic notices, disclosures, form confirmations, comparison or referral information, privacy notices, terms, consent records, rate-alert messages, responses to inquiries, and other records relating to a service or request you initiate with us.

"Services" means the comparison, educational, referral, rate-alert, solar, commercial-energy, contact, and related website features that UtilityProviders makes available from time to time.

3. Scope of Electronic Communications

When you affirmatively consent where consent is requested, we may provide Communications electronically to the extent permitted by applicable law. Depending on the feature you use, electronic Communications may include:

  • confirmation of a ZIP-code comparison, provider referral, contact request, business-energy quote request, community-solar inquiry, or home-solar inquiry;
  • terms, privacy notices, advertiser/referral disclosures, and updates to those documents;
  • rate-alert or savings-alert messages you specifically request;
  • responses to questions or support requests;
  • service-related notices about a request you submitted; and
  • information from, or links to, a provider or partner when you ask to be connected with that third party.

If applicable law or a separate agreement requires a notice to be delivered by a particular method, that requirement controls. A provider or utility may also require its own independent consent process.

4. How We May Deliver Communications

Electronic Communications may be made available through one or more of the following methods: email to the address you provide; notices displayed on UtilityProviders.com; a webpage identified in an email or form confirmation; downloadable files such as PDF documents; or text messages when you separately provide the required consent for SMS communications.

UtilityProviders does not currently require a proprietary mobile application to access the core website. If we introduce a new delivery method in the future, we may update this disclosure and provide any notice required by law.

5. Telephone and Text-Message Consent

Providing a telephone number in a general comparison or contact form does not, by itself, grant unlimited marketing permission. Where a form includes separate telephone or text-message consent language, that consent is governed by the wording displayed next to the form at the time you submit it.

If you affirmatively opt in to text messages, message frequency may vary and standard message and data rates may apply. Where offered, you may use the opt-out instructions included in a message. Consent to receive marketing texts is not a condition of purchasing a product or service unless applicable law permits otherwise and the relevant form clearly states the terms.

6. Withdrawing Electronic Consent

You may request to withdraw consent for future electronic Communications by using our Contact Us page and identifying the email address or telephone number associated with your request. For text messages, you may also use the opt-out method stated in the message when available.

Withdrawal applies prospectively after we have had a reasonable period to process it. It does not affect the validity of Communications, records, or consents provided before the withdrawal. Certain website features may be unavailable if they can only reasonably be delivered electronically.

7. Keeping Your Contact Information Current

You are responsible for providing accurate contact information and for notifying us if your email address, telephone number, or other relevant contact information changes. You can submit an update through our Contact Us page. We are not responsible for a failure to receive a Communication that results from inaccurate or outdated information you provided.

8. Technical Requirements

To access and retain electronic Communications, you should have a device with an internet connection, a current mainstream web browser with cookies and JavaScript enabled when required for site functionality, a valid email address for email-based Communications, and sufficient storage or printing capability to save records you wish to keep. Some documents may be provided in PDF format and require software capable of displaying PDF files.

Technology changes over time. We may update technical requirements when reasonably necessary to preserve access, security, or compatibility. If a change materially affects your ability to access legally required electronic records, we will provide any notice or renewed consent required by applicable law.

9. Paper Copies

You may print or save any webpage or electronic Communication for your records. If you need a paper copy of a particular UtilityProviders Communication, submit a request through our Contact Us page and identify the document requested. We will tell you before fulfillment if a reasonable mailing or reproduction charge would apply. Third-party provider or utility records must be requested directly from that third party unless we expressly state otherwise.

10. Electronic Communications as Written Records

To the extent permitted by applicable law, an electronic Communication may satisfy a requirement that a record be "in writing." You should download, save, or print any disclosure, consent, confirmation, or other Communication that is important to you.

11. Electronic Consent and Signatures

When a UtilityProviders form expressly asks you to click an "Agree," "Sign me up," "Submit," "Check availability," or similarly labeled control after presenting consent or disclosure language, your action may constitute electronic consent—and, where applicable, an electronic signature—to the terms shown with that control. The legal effect of any particular electronic action depends on the transaction, the language presented, and applicable law.

By providing electronic consent, you represent that you are authorized to act for yourself and, if you are submitting information for a business or another account holder, that you have authority to submit that request and consent on their behalf.

12. Third-Party Communications

UtilityProviders is independent and is not the utility or retail energy provider. If you choose to continue to a provider, utility, solar company, or other partner, that third party may communicate with you under its own privacy policy, terms, consent language, and electronic-communications procedures. UtilityProviders does not control those third-party policies.

13. Federal Electronic-Signature Law

The federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq., establishes rules concerning electronic records and signatures in transactions affecting interstate or foreign commerce. For consumer records that another law requires to be provided in writing, the Act includes additional disclosure and consent requirements. This policy is intended to describe UtilityProviders' electronic process in a manner consistent with those principles; it does not waive rights that cannot legally be waived.

14. Changes to this Disclosure

We may revise this disclosure when our website features, communication methods, or legal requirements change. The updated version will be posted on this page with a revised "Last updated" date. Where required by law, we will provide additional notice or obtain renewed consent before applying a material change.
